Refund and Cancellation Policy

Effective Date: 1 May 2026

By subscribing to Kira, you acknowledge that our services are strictly Business-to-Business (B2B). The standard consumer refund mandates under the Malaysian Consumer Protection Act 1999 do not apply to these commercial transactions.

1. Strict No-Refund Principle

All payments made to Kira Labs Sdn Bhd (1679437-P), including monthly subscriptions, annual commitments, one-time onboarding fees, and consumable add-ons, are final and strictly non-refundable. We do not offer prorated refunds for unused service periods, abandoned accounts, or infrastructure limit exhaustion.

2. Subscription Cancellations

You may cancel your subscription at any time via your account dashboard. You will retain full operational access until the exact end date of your current, fully paid billing cycle. Subsequent cycles will not be billed, but historical charges remain non-refundable.

3. One-Time Setup Fees

Fees charged for specialized setup or onboarding services compensate our team for immediate administrative labor. These fees become 100% non-refundable the moment the setup or verification process is initiated, regardless of your ultimate utilization of the software.

4. Chargebacks and Intellectual Property Revocation

We treat payment fraud and unwarranted chargebacks with extreme severity.

  • Repudiatory Breach: Access to the Service is a conditional intellectual property license. A payment chargeback constitutes an intentional Repudiatory Breach and total failure of consideration under the Contracts Act 1950.
  • Total IP Blackout & 72-Hour Cure: Upon detection of a dispute or chargeback, Kira shall execute an immediate "Total IP Blackout," instantaneously revoking all software access, explicitly including POS functionality. The Merchant is granted a strict 72-hour "Cure Period" to formally withdraw the chargeback with their bank.
  • Cryptographic Quarantine: If unresolved within 72 hours, the IP license is permanently terminated. To comply with statutory tax archiving laws, the Merchant's ledger will bypass immediate deletion and be placed in a "Cryptographic Quarantine" for 60 days. This data is recoverable strictly upon reversal of the dispute (evidenced by supporting bank documentation) and payment of an RM 500 administrative un-archiving fee to the payment method on file, both within the 60-day quarantine window. The Merchant unequivocally waives any claims for business interruption arising from this IP revocation.
